If you hold proof of a debt and fear the debtor will flee the country, you can apply to the judge of urgent matters, by petition, for an order banning them from travel.
If you hold a document proving a debt and fear the debtor will leave the country and your money with them, you can apply by petition to the judge of urgent matters for an order banning the debtor from travel.
What the application needs
- Proof of the debt: a cheque, a promissory note, a written acknowledgement, or a bank transfer whose purpose is clear.
- Something that shows the fear of flight is real, such as leaving a job, selling property or cutting contact.
What to do
The order on petition is issued quickly and without notice to the debtor. The claim for the debt itself must then be filed within the time limit. Do not delay: a travel ban is a temporary measure and lapses if no claim follows.
